There are several documents used when selling or buying real estate. Some of these documents are provided here as a service to my clients so that they may be familiar with them. This is not an exhaustive list.

These forms are provided in the “plain language” format. There is a short description above each clause.

This document is not a contract. It is used as a vehicle to confirm the ethical practice of explaining the various types of representation. Sellers and buyers initial, sign and date this form signifying their understanding of the different types of representation.

Listing Agreement – click here to view/download

This document is a contract between the seller and the brokerage. It formalizes the relationship between the brokerage and the seller. It also gives the brokerage the authority to market the property exclusively for a certain length of time.

Before signing a listing agreement, you should have your latest tax, heat and hydro bills at hand so that an accurate reflection can be posted to the listing.

Buyer Representation Agreement – click here to view/download

This is a contract between the buyer and the brokerage. It formalizes the relationship between the brokerage and the buyer. It states how long they will be working together exclusively, the geographic region, what they are looking for, and the remuneration terms.

Confirmation of Representation of Cooperation – click here to view/download

This is a form which confirms the parties to an agreement. This form is submitted along with the Agreement of Purchase and Sale.

The Agreement of Purchase and Sale is a contract between two parties for the purpose of conveying rights to real property.
